Interim Enforcement Statement

Stirling Council are continuing to investigate planning enforcement matters. 

Our enforcement Team may be limited to the type of site visits that they can undertake due to the Scottish Government Guidance at the time of your enquiry. We will continue to review this situation on an ongoing basis and adapt our approach to reflect Scottish Government advice and regulations.

To assist us, we would ask that you provide as much information as possible when submitting an enquiry to our Enforcement Team.

Our Enforcement Team are prioritising enquiries that have the most significant impact upon the public, and this may take us longer to investigate householder developments.

Enforcement within the planning process is necessary for monitoring development and investigating potential breaches of planning control.

Stirling Council is empowered to not only investigate possible unauthorised developments but can also take any appropriate remedial action. The main areas of investigation involve unauthorised changes of use of land or buildings, work being carried out without planning permission and breaches of conditions attached to planning permission.

Where possible the Enforcement Team will remedy unauthorised actions through negotiation rather than statutory action, perhaps by way of a retrospective application, or suggested alterations to ongoing development. However, in cases where a breach has a detrimental impact, the Council can serve an Enforcement Notice, or even a Stop Notice requiring the immediate cessation of activities.

Enforcement Notice Register Summary

Aspects of the Enforcement Register can now be accessed electronically via the Planning Portal. A Summary of the Enforcement Register has been produced and is updated regularly. Should you require further detailed information about an enforcement notice, the complete Enforcement Register is available to view at our offices between the hours of 9.00 am and 5.00 pm

NB Planning permission is required for most development, and enforcement action can be taken if work is being carried out without permission. Any enquiry/complaint shall be dealt with in confidence, however, if a criminal case is sent to the Procurator Fiscal your details would require to be disclosed.
